Reminder and Suggestion - Judas

just a reminder: while we are deep into discussions regarding the questionable quarry ordinance, is there someone watching over comelec? baka kasi mabulaga tayo! mabibigla na lang tayo at na-wowowee na tayo!

anyway, when among ed vetoes the ordinance, how will the process run? will he present his position to the SP during their session? if so, would it be possible for some of us to be in the gallery?

and should the SP overrun among ed's veto, should we not also be present in that session?

The Crusade is Alive - Judas

the crusade is alive!
there was a consultative meeting held at st. jude parish just this evening, 6:30pm. the church was almost full, the faces familiar. balamu anyang kampanya!

among gov. gave an update of the situation at the capitol. after that, atty. velez gave a presentation of SP ORDINANCE 172, pointing out its deficiencies, inconsistencies and dire prospects.

after the presentation, some NGOs presented a paper asking among ed to VETO the proposal!
atty. dante david read a letter he gave to among ed earlier in the day. in that letter, he pointed the legal aspects, effectively giving among ed a basis to explain the VETO. he also asked among ed to veto the ordinance.
next came a slide show with pictures of the sorry state of public schools especially in masantol and macabebe. if among ed would not veto the ordinance, the provincial govt. would be rendrered inutile!
the final word from among ed was that he would VETO SP ORDINANCE 172!

bishop ambo closed the meeting with a prayer and blessing. we prayed even for vice-gov, the sp and mayors. bishop ambo is a firm believer in the goodness and decency that is inherent in humanity. i believe among ed believes in that too.

this is a portent of things to come, good things! however, expect the usual negative things tomorrow! but even then, i believe we all have to keep our focus on good governance and good citizenship.
another consultative meeting is scheduled for friday, 1:30pm. i think it will be at partyland. go there and see for yourself! go there and feel the spirit of our crusade throb with life!

Is Among Ed going the way of Mark Lapid? - Sylver Phox

I am a supporter of the now governor Among Ed Panlilio of Pampanga.

Below is an email message I sent my provincemates:


My fellow lovers of truth,

We all share the experience of pouring our hearts and minds to support the struggle of a humble and moral man last elections.

I still beleive Among Ed is that same man but has entered the jungle of politics which some characterize as a word of snakes and crocodiles.

Becoming governor completely changes everything.

I am sincerely in fear that our beloved governor is in peril of falling into a quicksand unless we exert renewed effort to help him. I compose this letter in the way my limited abilities afford me. I pray you see matters in the same light and do what little you can the exact same way we carried Among Ed to victory, a little effort from a lot of people.

This is the basis for this fear:

Watching the local news on Infomax 8 this evening of Saturday, Sept 22, one of the articles was about Yeng Guiao noticing that official receipts of Lahar collections are having their CONTROL NUMBER being torn off, "tilasan" was the word. Silently i felt that "opposition" people were faking these "tilas" so that they may bring more things to throw at Among Ed's administration.

Dismay overcame me upon seeing the response of Atty. Dabu:

1. We really tear the CONTROL NUMBERS because that was the practice we inherited (implied that Lapid's unaccounted system was actually right)
2. We need to tear them because drivers use them again to get Lahar.

Are we riding the "stupid train" for an attorney, no less than the annointed one by Among Ed who serves as his "right hand", the "trusted" one, to provide such an answer?

Does she expect us to believe that a CONTROL NUMBER is a mere decoration and can be "tilas" on a whim?

Did not the best mind of Among Ed's advisers deliberate on such a central source of "kurakot"? Lapid deliberately tore off CONTROL NUMBERS to HIDE the volume of money involved in Lahar.

I was skeptical to what I was hearing previously about the gripes of the local press, Sangguniang Panglalawigan, Lolita Hizon and local mayors against Among Ed's administration specifically Attys Dabu and Velez. Brushing them off as "political demolition jobs".

After tonight, I am now afraid. Afraid that Among is slowly being surrounded by the corruption he set out to fight not seeing what is really happening in the cloak of a cordon sanitaire. Where would he get his information aside from his trusted aides if we do not take the initiative.

Granted that Among Ed is a Moral man, are the two attorneys impervious to temptation? Temptation will be far greater in the absence of a properly implemented accounting system.

If you beleive Atty Dabu's explanation, you should believe that the ZTE contract for the NBN deal was also stolen both in the Phil and in China, therefore no copy can be shown.

I smell fish! Can you?

It would be painful and shameful to witness a holy man be buried by the very people he trusted and what a priest could not fix a jueteng lord could.

Lastly I thank you in indulging me in the burdens of my heart by taking the time in reading this message. I will appreciate it more if you can forward it to our co-supporters of Among Ed adding your own comments either agreeing or not with my views. It is important that people may know the truth.

On Pampanga Media's Continuous Attacks on Among Ed - KIM

One can't help but continue asking questions on why local media continuously attack Among Ed. I say 'attacks' because the effort is concerted in nature. They would like it to appear that they are making arguments or comments but if one looks at the bigger picture and take into consideration all the articles since Among Ed's assumption into office, one can make a plausible conclusion that they are against Among Ed.

Why? Is it because they do not want good governance as exemplified by Among Ed? Is it because they receive money from other camps to write articles against the good governor? Is it because they have no other newsworthy events that they can write about?

When Among Ed was able to immediately turn around the quarry tax collection scheme, a handful of articles came out locally congratulating Among Ed. In contrast national media was euphoric and even regarded Among Ed as a national treasure. Why the disparity in interpretation of events? Of late when 'fake receipts' cropped again, local media is quick to pick up the story and berate the gains in quarry collection of Among Ed.

If local media would only play its role of informing our people and making incisive commentaries, they would have raised the issue (and should continue to raise) of the low quarry tax collection during the Lapid administrrations.

If local media would only play its role of informing our people and making incisive commentaries, they would have questioned the real intent of Pampanga Mayor's League Ordinance 172.

If local media would only play its role of informing our people and making incisive commentaries, they would have noted the fact that the real issue against Atty Dabu and Atty Velez are their personalities vs their ability to work in government and have by now realized that they are incorruptible.

If local media would only play its role of informing our people and making incisive commentaries, they would have picked up the gains in good governance since Among Ed assumed the governorship.

Until such time local media show objectivity, they have lost their credibility.

I wonder if any of our local media have aspired to write for national dailies? No wonder they are still in local media.

Musings on Ordinance No. 172

According to news report, the Pampanga Mayor’s League (PML) has
proposed an ordinance seeking a bigger share of revenues for sand-rich
municipalities and barangays and stronger regulatory powers over the quarry
industry. The Provincial Board tackled the planned measure in its regular
session on Sept. 10.

Let me share my observations on this proposed ordinance.

1. The proposed ordinance is loaded with defects and fraught with
ambiguity.

It lacks adequate authority. No provisions of law are cited to support
the proposal that mayors are mandated to regulate quarry industry
except Sec. 138 of the LGC, which is now the subject of amendment in Senate
Bill No. 1161 being introduced by Sen. Pimentel. The bill seeks to
amend various provisions of LCG and requires the promulgation of
Implementing Rules and Regulations. With this development, the proposed measure
is seemingly premature.

The body of the proposal lacks the salient features of an ordinary
ordinance like purposes and objectives, declaration of policy, definition
of terms and governing laws.

This ordinance may partake of the nature of tax law which requires
holding of public hearing and approval by the Secretary of Finance in
addition to the usual requisites of publication of ordinance. (Tuazon vs.
CA, 212 SCRA 739). Section 10 of the proposed ordinance is not compliant
with this requirement.

The repealing clause practically obliterates all existing ordinances,
memoranda, orders and issuance, to wit :

“Section 8. Repealing Clause. All previous ordinances, memoranda,
orders and issuances by the Province are hereby repealed and/or modified
accordingly.”

Section 8 clearly indicates that this ordinance automatically repeals
all previous ordinances, memoranda, orders and issuances, meaning all
previous ordinances enacted by the first PB up to time this ordinance is
approved are no longer existent.

The Repealing Clause should have been worded in this manner :

“All previous ordinances, memoranda, orders and issuances by the
Province are hereby repealed and/or modified accordingly insofar as they are
inconsistent with the provisions of this Ordinance.”

The proposed ordinance also violates Sections 42 to 52 of Republic Act
No. 7942 (Philippine Mining Act of 1995) which defines the power of the
governor to issue permits (small-scale mining, quarry, commercial sand
and gravel, government gratuitous, private gratuitous, guano and
gemstone gathering and regulate the mining industry.

2. The Local Government Code (LCG) provides that permit to extract
sand, gravel and other quarry resources shall be issued exclusively by the
provincial governor. This exclusive power carries an ancillary power
to regulate the quarry industry. The proposed ordinance, in effect,
delimits the regulatory power of the governor over quarry industry.

I feel this is beyond the legal authority of the mayors. It’s a clear
ultra vires act which may render the proposed ordinance void if
judicially challenged.

3. In paragraph 1 of Section 138 of the LCG, the provincial government
“may” collect or levy not more than ten percent (10%) of fair market
value in the locality per cubic meter of quarry materials.

This provision is directory in nature in that it gives liberty to the
provincial government as to how much of tax is to be levied on quarry
resources subject to certain restriction (not more than 10% of fair
market value). Based on this, 150 pesos tax on quarry materials per truck
load and 150 pesos administrative fees for regulating the industry
including the allotment of tax proceeds (45-45-60) was formulated and
sanctioned by the Provincial Board and the national government (DENR).

The mayors now want the administrative fee be abolished and their share
of the revenues increased by 45 pesos per truck load load. Why only
now? Why they did not do so during the incumbency of the Lapids? What’s
wrong with the present system? Is that because they are now unable to
extract money from extraction of the quarry materials?

While the governor’s exemplary quarry collections has received
accolades from countless of Filipinos around the world and prominent
journalists, our honorable mayors are now attempting to remove the transparency
with which the quarry revenues are being collected by the Governor Ed.

Aren’t they proud that the quarry collection is now free from
corruption and the quarry monies do not go anymore to the pockets of the
governor and other corrupt government officials? What kind of mayors and PB
members do we have? How can the province grow when we have grown-up
officials who openly undermine the progress we are all dreaming of?

Ordinance to change the distribution of quarry revenues - Kim

The news about a new ordinance submitted by Mayor Dennis Pineda to change the sharing of quarry revenues and give mayors more control on quarry operations is a blindsided attempt to restrict the impending growth and development of Pampanga under the leadership of Governor Ed Panlilio.

Anybody who reads between the lines can conclude that the mayors, who used to earn millions out of corrupt practices in the quarrying business, are wary and afraid of the transparency of Among Ed that they want to wrest control of its operations.

If this ordinance will be passed, the provincial government's share of quarry revenue will be cut in half. This will affect the plans of Among Ed in delivering basis services to the poor and in sharing the provincial government's share of revenue to municipalities that do not have quarry operations.

I wonder what the majority of mayors whose municipalities do not have quarry operations think about this? Or, have they already been impressed upon by a higher power to support this?

If Yeng and the PB approve of this ordinance, one can't help but conclude that this is another attempt to restrict Among Ed's plans for Pampanga, another decision made by a higher power and dictated to his minions.
